White House 'will not co-operate with removal request'

Feb 16,2020 6:58 am

The White House has officially announced the cooperation with The Law enforcement investigation against President Donald Trump refused.

A letter to the Democratic leaders, it rejected as "baseless" and "constitutionally invalid".

Three Democratic-run House committees to investigate, Mr Trump.

The investigation is trying to determine whether The President held back, to push aid to Ukraine to investigate, Joe Biden , who is in the race for the democratic presidential nomination.

The White House letter to appear before the Congress Impeachment investigation.

What does The Letter say?

the leading Democrat and speaker of The House of representatives, Nancy Pelosi , and the three chairmen of the Democratic committees.

He threw the leaders of the institution a request that "violates fundamental fairness and the constitutional officers due process".

The Letter insisted that, because the Democrats don't hold to start a vote to Impeachment proceedings in The House , the question of The Constitution was "legally invalid".

The Letter also Democrats accused of trying to change the 2016 election result, and "deprive The American People The President they have freely chosen".

"in order to fulfill its obligation to The American People . President Trump and his government on their party political and unconstitutional investigation under these circumstances. try "

In answer, and the defendant, Mr Trump, "the normalization of lawlessness".

"Mr. President , you are not above The Law . You will be held accountable. "

What is the latest in the indictment request is?

Mr Cipollone's letter comes hours after the White House blocked Gordon Sondland , the US Ambassador to the EU, speaks from the three Democratic committees behind closed doors.

the Text messages released last week, show Mr. Sondland discussed efforts to pressure Ukraine through Mr Biden with other American diplomats.

Top U.S. diplomat Bill Taylor and Gordon Sondland text messages, which were released on Thursday Robert Luskin said Mr. Sondland was "deeply disappointed", as he traveled to Washington, from Brussels in order to prepare for his appearance.

"Ambassador, Sondland said convinced that he acted at all times in The Best interests of the United States , and he is ready to answer The Committee 's questions completely and truthfully," The Statement .

In a tweet, The President , said Mr. Sondland would only appear before a "kangaroo court".

But House intelligence committee chairman Adam Schiff told reporters the envoy had, SMS-messages or E-Mails "deeply relevant" to the question on a personal device. He said that these communications have been handed over to The Department of State, was the source of tax.

"The failure to have this testimony," added the California Democrat, "the failure to produce these documents, we consider additional strong evidence that the disability of the constitutional functions of the Congress. "

On Wednesday, Republican Senator Lindsey Graham , a staunch Trump Ally , told Fox News ' Morning Show that he believes that Ukraine-is a matter of an impeachable offense.

Mr. Graham of South Carolina added that he intends to ask his fellow senators to sign a letter to Mrs. Pelosi in an attempt to stop the Impeachment proceedings "before it destroys the country".

A self-inflicted wound

the analysis of Jonathan Turley , a lawyer,

a letter, of The Law concern about the lack of a vote and the secrecy of the proceedings. The Democrats have, the Republicans are limited in their efforts to question witnesses and secure material. However, this is not a legitimate basis for the refusal of cooperation or the provision of clearly material evidence.

The Letter emphasized that a lack of due process in the proceedings. Still not in The Constitution explicitly, something other than a vote of The House on Impeachment itself, and a majority of the threshold value for each of the referral of The Matter to The Senate for trial.

This is a constitutional function of the highest order for the Congress. It is a legitimate basis for the congressional investigation, under the supervision and prosecution authority. If these allegations of self-dealing, proved to be a basis for the indictment could be. A President can not simply a set of marbles to pick up and leave The Game , because he does not like The Other players. A refusal to cooperate with a constitutional representative process can be an abuse of power.

Mr Trump's previous tweet about the desire to witness an Ambassador (but not blocked him, because he is to claim the confidence of The Committee ), the death knell for the privilege. A President can not hold back material evidence, because he does not like The Other party control of one House of Congress. It is based on a claim that a disclosure, even an equal branch, would undermine the National Security or diplomatic relations, or material of a confidential communication.

This letter is to cooperate, faulty premise for the refusal is repeated. It is a strange thing, because the tweets of Mr Trump may be dismissed (such as The Department of Justice in the immigration court proceedings) as not reflective of the actual position of the government. Now, the White House Council itself, the same arguments adopted.

The Letter adds another avoidable self-inflicted wound, which a White House that seems intent on counter-punching in an indictment. There are objections, here, as a viable privilege arguments. This letter is, however, exempt these objections with Reckless Abandon .

Jonathan is a professor of Constitutional Law at the George Washington University

Two weeks in The House of representatives, " Impeachment inquiry, the constitutional crisis is approaching US.

While the White House and the written answer from Speaker Nancy Pelosi took eight pages, The Message was simple. No Deposits. No Documents. To delete any cooperation.

The administration is the question of the legitimacy of the entire investigation, calling The Process "unconstitutional". Democrats counter that The Constitution gives The House "the sole power of Impeachment " and that she has also agreed to continue their investigation with or without the White House .

Democrats have several options. Could the administration for a disability quote and make that an article of Impeachment .

you could attempt for the White House has not specified requirements to encourage in the hope of their support.

Or you could try to force the courts to cooperate with the White House .

The justice may not, however, judge willing to, a stand-off, the nothing less than political warfare. This raises the very real prospect that Mr Trump may feel that he has to respect it, any conclusions that The House - and, if It Comes to that, in the question of the effectiveness of The Senate study, as well.

This is Uncharted Territory . And as both sides confirm (albeit drawing very different conclusions), to The Presidency - and also, perhaps, the rule of law itself are at stake.

Why is it an indictment request?

Biden, The Democratic-led Committee of inquiry wants to find out if The President held back almost $400 million (£327m) in the help of the pressure-Ukraine-President -Vladimir Zelensky, the establishment of a Committee of inquiry, Lord.

hunter, Mr Biden, whose son sat on the Board of the Ukrainian energy company.

Mr Trump and his supporters believe that Joe Biden has used to force his position as vice President , Ukraine might have to drop a probe into The Company involved his son in misconduct.

These claims have been largely discredited.

In a telephone conversation on 25 July, Mr Trump, Mr asked Zelensky, to check Mr Biden.

But a U.S. whistleblower concerns about the call. Shortly after that, Ms Pelosi announced a formal prosecution investigation.

On Tuesday, a lawyer for The House , told a Federal judge that the prosecution's investigations extend beyond the Ukraine, to include alleged obstruction of justice by The President .

the Democrats are currently fighting the Ministry of justice for access to the unredacted Mueller Report into allegations of collusion between the 2016 Trump campaign and Russia as a part of this disability request.
