Coronavirus: Are there any legal protests in the midst of lockdown?

Nov 25,2023 1:11 am

Protesters chanted "black matter" and "say my name, George Floyd live" on Trafalgar Square

solidarity protests against the death of George Floyd in the United States are still held in the UK - But they are are actually legal, in view of the coronavirus lockdown?

What is the lockdown should laws have to say about the protests?

England now has the lock, The First lockdown in the UK, without restrictions, to the outside. But The Rules (officially known as The Rules ), does not say explicitly anything about it, whether people protest or not.

But , regulation seven limited public gatherings to no More Than six people.

The Law defines a "collection" such as a meeting with "social interaction with each other, or other activities". And this means, therefore, quite clear That a protest is currently illegal, along with other activity, could increase the spread of The Virus .

What are the penalties you could face for participating in a protest?

police have tried to encourage people to follow The Law and the message for the health care system, and can assemblies to break. Before the death of Mr. Floyd, this tended to stop my officers, directed by major parties and the order of people, to their own homes.

hand strength penalty is may officers - a form of on-the-spot-Ticket start at £100 for anyone who does not follow the health regulations. You can also arrest and charge someone with a crime, which may be a high level of fine in a magistrates' court.

So you take together all the officers have The Power to Ticket people as part of a protest, the coronavirus health reasons.

The Road to the U.S. Embassy in London was blocked by a protest there is a right to protest in the UK?

Yes, But here it is then rather difficult, because The Law is often misunderstood. And the coronavirus, health emergency complicated things further.

Barrister Cherryl Audrey Mogan, of the London-based Garden Court Chambers, explains, the European Convention on Human Rights (in UK law as the Human Rights Act) States That public bodies must take care to mount The Right and also the expression of views.

But both of these rights are not absolute. The government or other public authority can interfere with them, if there is an appropriate legal reason to do so.

"So it is a Balance exercise," she says. "If what is made is for the enforcement of health regulations, then you can argue That [end of protest] would be appropriate and proportionate.

"But , this is the context where We Are right now, is important.

"We Are not on The First day of the closure. It is very clear That you are permitted to gather outside, though only in groups of six. "

Ms Mogan argued, The Police , should these protests in the same way That the senior employee would consider a park full of sun-bathing friends.

"you see, there are people in small groups in parks. It is not very hard to argue, they are All In The Park for the same purpose. So, if We Are talking about, to stop a protest, it is a fair and equitable application of The Law to these persons, as well as those in The Park . "

If not, warns you to close a Black matter protest on coronavirus-site Lives, it could be discrimination.

So where are The Police ?

the Chief constable's talk today about your state's obligation to "facilitate" demonstrations.

And it seems pretty clear That The Police do not want to break the Black lives matter demonstrations, even though, on paper at least, they would hurt, coronavirus laws.

Metropolitan Police Commissioner Dame Cressida Dick told the London Assembly on Wednesday That its officers were faced with a difficult situation on the last Saturday than 3,000 people demonstrated in London to Lord it over Floyd's death.

"If you engage yourself in The Shoes of a public order commander dealing with a protest, the almost out of nothing, which has no organizer, no one is With You , then you have to have their judgments at The Time ," She Said .

she added That the officials decided That they had tried to force a mass of confusion, "we would probably have ended up with very severe disease".

you and The Other members of the National Police chiefs Council, instead, a very strong and unusual statement in The Hope of calming tensions.

they said they were appalled by the decision of Mr Floyd's death in Minnesota and know people want to make their voice audible.

"The Right to lawful protest is an important part of any democracy, the true British police, and to promote," The Statement added.

He noted That in the case of events with More Than six people outdoors to a limited extent, "we ask That people continue to work, with employees in this difficult Time ."
