Nov 22,2023 11:11 am

The so-called "rough sex wrong defense gone be prohibited", in the new Domestic Abuse legislation. a Justice Minister has told MPs.

Alex Chalk said it was "outrageous" that the defense can be used In Court to justify or excuse the death of A Woman who "consented just because they are".

He Said it would be "Crystal Clear " in that it was acceptable.

The Bill for England and Wales, is set to become law later this year.

Jess Philips. Labour's shadow minister for Domestic Violence and the protection, had submitted, to prevent the amendments to the legislation, the lawyers of the defence, but it drew the following representations by Mr chalk.

The Campaign group We Can not consent to prohibited the defense, said the minister, the answer was: "a big Step Forward ".

If successful, the "rough sex" defense can be set to a lower.

Choking

We Can not consent To This, has collected 60 examples of Women "who were killed during the so-called "sex games gone wrong" in the United Kingdom, since 1972.

The Group in a "lesser charge of manslaughter, a more lenient sentence or the death was not investigated as A Crime at All ".

There are 115 People - All , except one, were Women had to compete in front of a court, where, it is claimed that The Group agreed to a severe injury.

The violence in the non-fatal attacks included waterboarding, wounding, strangulation, beating, and choking.

Speak to MPs on The Commons ", Public Bill Committee, Jess Philips, said: "The Law should be clear to All - You cannot consent to serious injury or death, but the case law is not up to The Task . "

She Said if A Woman is dead, "You can't speak for themselves," but every man charged with the killing of A Woman , or a current or former partner could "to just say You wanted it".

"that's why we need to change The Law ," She Said .

Alex Chalk , answers for the government, said: "It is irresponsible to suggest to the defendant that the death of A Woman , is justified, excusable, or legally defensible, because the woman had activity in violent and harmful sexual to consented what is your death, just because of You . "

'Inexcusable' defense

He Said it would be "Crystal Clear " in the Domestic Abuse Bill, but he was concerned by the wording of Ms Phillips amendment would allow criminal lawyer "game room".

He Said the government's approach is to step through The Report - The Next Stage in The Bill 's progression through Parliament. Ms Phillips said she was satisfied with this insurance.

We Can't say that has the approval of This Initiative, what was happening in Parliament, "is really a great Step Forward ", adding: "We should know within weeks what are your suggestions and if You have already gone far enough".

Earlier this month at Prime Minister 's Questions, Conservative MP Laura Farris a leading role in the fight against Domestic Violence said the government had taken over, but said it was "an ugly dimension, remains unresolved" on the issue of the rough sex defense.

In response, Prime Minister Boris Johnson , said: "We Are obliged to ensure that The Law is made clear and that the defense is inexcusable. "
